Player Release of Liability and Registration form

Your signature at the bottom of this form means you understand the risk you are taking playing softball and you agree to volunteer up to 20 hours per year to be a member of the 3 Score Softball Club.

Waiver Release & Assumption of Risk
I hereby waive and release, indemnity, hold harmless, and forever discharge 3 Score Softball Club, Inc. and its agents, employees, officers, directors, board members affiliates, successors and assigns of and from any and all claims, demands, debts, contracts, expenses, cause of actions, lawsuits, damages and liabilities of every kind and nature whether known or unknown, in law or equity, that I ever had or may have arising from or in any way related to my participation in any of the events or activities conducted by, on the premises of or for the benefits of 3 Score Softball Club, Inc. provided that this waiver of liability does not apply to any acts of gross negligence or intentional, willful or wanton misconduct.
By this waiver, I assume any and all risk and take full responsibility and waive any claims of personal injury, or death to person or damage to personal property associated with 3 Score Softball Club, Inc. including but not limited to engaging in softball practice, games, pick-up games, leagues, running exercise, general training for the sport, spectating, or using the softball facility and its equipment or other related activities on and off the premises.
I understand that I am agreeing to play in a 3 Score Softball Club consisting of players from ages 60 to over 80 years old. The Players are of all skill levels, very advanced skills, intermediate skills to very poor skills. I expressly contract and agree not to sue any other participant of the 3 Score Softball Club, Inc. I understand that this express contract and agreement is a total bar from recovery for any and all inherent risk in the contact sport of softball. This includes, but is not limited to, being hit by a softball, hit by a bat, collision with another player, collision with objects or terrain in or around the field complex. I agree that I am voluntarily participating in the 3 Score Softball Club. I waive my right to be free from those bodily contacts inherent in the contact sport of softball including senior softball for those 60 and above. I further agree that I have full knowledge and appreciation of the very real dangers inherent of severe injury or death in the contact sport of softball, including senior softball for those ages 60 and above.
I hereby release 3 Score Softball Club, Inc. and all its agents, officers, directors, board members, servants, team sponsors, league officials, employees and any other parties connected with the club from any liability whatsoever in connection with the negligent acts by 3 Score Softball Club, Inc. as well as in connection with the running, the planning, the participation of any and all softball games, practices, pickup games that are run and or scheduled by 3 Score Softball Club Inc. all on behalf of myself and all other participants. The scope of this release shall include, but not be limited to damages, losses or injuries encountered in connection with transportation, food, medical concerns (physical and emotional), entertainment, photographs and physical injury of any kind including contracting any virus or sickness that could be transmitted by another participant. I further agree to hold harmless and to release 3 Score Softball Club, Inc. from and against any and all claims and causes of action of every kind arising from any physical or emotional injuries and/or damages which may happen to me.
In consideration of the acceptance application and registration for membership I hereby waive and release the 3 Score Softball Club, Inc. its agents, team sponsors, league officials and any other parties connected with the Club from all damages or actions whatsoever in any manner arising or growing out of the participation in the 3 Score Softball Club, Inc. I attest that I am physically fit and sufficiently trained in this type of activity. Also, by my signature I accept all the rules and bylaws of the 3 Score Softball Club, Inc. Also, I hereby grant permission to managing personal or other personnel, to authorize and or seek medical care should said player become ill, injured or incapacitated while participating in 3 Score Softball Club activities.
Also, 3 Score Softball Club members are required to purchase their uniforms from 3 Score softball club only. All members will wear the full uniform in each game played. The uniform is pants, shirts and hats. All clothing worn for warmth will be worn under the uniform. Maintaining your uniform is necessary and is the responsibility of the club member.
Additionally, when called upon, all members of the 3 Score Softball Club Inc. are required to donate a minimum of 20 hours of volunteer work per year to the city of Clearwater. I further understand that this volunteer work is mandatory and not an option. When called upon to do volunteer work and you have not fulfilled your minimum 20 hours of work and you refuse to do volunteer work you will be subjected to dismissal from the club with no reimbursement of dues. The city provides the fields for 3 Score Softball Club, Inc. at no charge and we as members provide volunteer hours for events held within the city of Clearwater to pay for the use of the fields.
Also, I hereby grant 3 Score Softball Club, Inc. and all its agents, permission to use my photographic portraits, pictures, digital images, or videotapes of me, in which I may be included in whole or part, on or for: Publications, Pamphlets, Posters, Ads, Videotape Material, Website, or for any other promotional activity, without payment or any other consideration.
I have read, understand, and fully agree to the terms of this waiver and release. I understand that this form will remain on file with the 3 Score Softball Club, Inc. for the current season which extends 13 months from January to February of the following year. I understand and confirm that by signing this waiver and release I have given up considerable future legal rights. I have signed this agreement freely, voluntarily, under no duress or threat of duress, without inducement, promises or guarantees being communicated to me. My signature is proof of my intention to execute a complete and unconditional waiver and release of all liabilities to the full extent of the law. I am 18 years of age and older and mentally competent to enter into this waiver and release.
